After prevailing against defendants' motions to dismiss the case on fair use and First Amendment grounds, the settlement included Defendants' public apology and pledge to respect artists' right and to obtain licenses for the use of copyrighted works in the future.
Iser currently represents the Leonore S. Gershwin 1987 Trust in litigation pending in the Southern District of New York against music publisher Warner/Chappell involving the administration of the copyright interests of famed lyricist Ira Gershwin outside the United States. Mr. Iser also is lead counsel in the defense of Roland DGA Corporation, a leading distributor of wide format printers, in a patent infringement case pending in the District of Connecticut, represents Mattel, Inc. in trademark opposition proceedings, and represents Zobmondo!! LLC in a trademark infringement action over the use of the mark WOULD YOU RATHER.
