U.S. Congressional Candidate (42nd District) Lee McGroarty is calling for a criminal investigation of Congressman Gary Miller in what the McGroarty campaign calls an “Earmark Funding Scheme.”

McGroarty and his campaign team have pieced together records, articles and actual events and have taken their case to the District Attorney’s office, asking that the possible “corruption” come to an end.

The campaign is alleging Congressman Gary Miller has used Federal Earmarks to finance his own Political Action Committee (PAC) as well as funneling these same Earmarks to influence his pending land deal in Rancho Cucamonga, California.

Early Tuesday morning, McGroarty met with the San Bernardino County District Attorney's Office and provided a detailed packet of information regarding a series of questionable dealings by Congressman Gary Miller (R) 42nd Congressional District, California.

McGroarty has made it clear that his intention, as a 42nd district candidate, has never been to use Congressman Miller’s past scandals as a campaign strategy or advantage. Rather, McGroarty has focused on fundamental differences with Miller such as key, primarily fiscal issues such as his votes on sub-prime lending, TARP, TALF and cash for clunkers.

Several months ago, McGroarty and his campaign team started paying attention to past frequent earmarks (many outside the 42nd district) that were sponsored or co-sponsored by Congressman Miller. These earmarks are a matter of public record and can be viewed at According to those same reports, many were intended for three non-profit organizations that shared a common address in Rancho Cucamonga. All three organizations were connected to Jeffrey Burum, whom media reports and Attorney General Jerry Brown has identified as an un-named co-conspirator in "one of the most appalling corruption scandals in California history.” District Attorney Mike Ramos called the allegations "the biggest political corruption scandal in San Bernardino County's history." These statements were made when San Bernardino officials were first indicted on corruption charges related to a deal between the County of San Bernardino and Colonies Partners, a Jeffrey Burum company.

When this recent scandal broke in San Bernardino County, with numerous references to Burum’s possible involvement in "conspiracy, corruption and bribery", the McGroarty campaign wanted to make sure 42nd District voters were aware.

According to Save Our Mountains Alliance, Congressman Miller has a personal land deal pending before the Rancho Cucamonga City Council and citizens have raised concerns that Congressman Miller is influencing the Council's decision in granting the zoning approval. Rancho Cucamonga is outside of the 42nd District. records will also show that Congressman Miller has received more than $50,000 in campaign contributions from Burum and his associates since 2004, around the same time as his land purchase.

“At best, these facts show a conflict of interest and questionable ethics; and at worst, may show criminal activities, but that is for the District Attorney to decide. I am calling for the DA's office to expand their investigation to include Congressman Gary Miller and his involvement with Jeffrey Burum, his earmarks and his pending land deal with the Rancho Cucamonga City Council,” said McGroarty. “We have also passed this on to the FBI which has been investigating Congressman Gary Miller for a similar land deal in Monrovia, CA as well as the California Attorney General's Office.”
