The key to a successful project is good contract development and enforcement of requirements contained in the contract or protections. Without that, contract protections may be lost or waived. The webinar will provide strategies to avoid claims, before the project begins as well as during the project, covering, among other things, the following areas:
- Choosing the proper project delivery method.
- Advance planning for claim avoidance and mitigation.
- How to measure the contractor’s performance: quality- and quantity-based measurement systems.
- Recognizing early warning signals of a troubled project.
- Dispute and claim mitigation: proactive monitoring and intervention.
- General methodologies for proof of damages.
One of the featured speakers during the webinar will be Kyle Ostergard, a partner in the law firm of Alston + Bird LLC. He focuses on construction law, suretyship, and business disputes. He drafts and counsels clients on contracts of all types. He has represented owners/developers, general contractors, and subcontractors in connection with all types of construction projects.
Ching Wei, director and a founding member of Criterium Consulting Group Inc., also will address webinar attendees. His firm specializes in project and construction management as well as litigation support, alternative dispute resolution, and claims analysis services to the construction industry, government contracting groups, and business communities. He is engaged by law firm clients to testify as an expert on topics including schedule delay, work disruption, and related costs and damages. He also is engaged by construction and manufacturing clients to set up schedule, cost, and administrative controls on large-scale complex projects.
In addition, a 10-to-15 minute period has been reserved at the end of the speaker's presentation for an interactive question-and-answer session so that webinar attendees can discuss specific issues or gain additional knowledge about topics discussed.
