The Simmons law firm will address the implications of a new Illinois Appellate Court decision it recently won during the upcoming “Midwest Asbestos Litigation Conference” in St. Louis.
The 5th District of the Appellate Court of Illinois ruled in June that employers have a duty to warn the families of their employees about the dangers from take home asbestos exposure. Take home exposure occurs when an employee brings asbestos dust home from work, most often on his clothes or skin, thereby exposing his wife and children through traditional family interactions like laundry and playtime.
Firm asbestos attorney William Kohlburn, who worked closely on the case (Simpkins v. CSX Transportation No. 5-07-0346), will lead the workshop session which will investigate if the decision could lead to extending that duty to non-family members.
