Jeffrey J. O'Hara, a highly regarded Grand Rapids, Mich. criminal defense attorney, secured not guilty verdicts on both counts in the trial of a man who was accused of causing the death of a motorcyclist during a tragic 2009 traffic accident in Grand Rapids.
The case, People of the State of Michigan v. Ronald Edward Windom (Case No. 09-11205-FH), attracted significant attention in the community because the defendant was charged with causing the fatal accident while driving intoxicated and with a suspended license. The three-day jury trial took place in the Kent County Circuit Court before Hon. Donald A. Johnston and the verdict was announced after just three hours of deliberation.
The collision occurred at approximately 2 a.m. on September 5, 2009, between the vehicle Mr. Windom was driving and the motorcycle driven by 41 year-old Stafford Ray. The impact of the collision, which took place on South Division Avenue, south of Hall Street, caused Mr. Ray's Kawasaki motorcycle to explode in flames.
Mr. O'Hara introduced evidence in the trial that suggested Mr. Ray was traveling at least 75 MPH in a 30 MPH zone at the time of the accident. After the jury rendered their not guilty verdicts, individual jurors reported that the evidence presented to them regarding Mr. Ray's reckless rate of speed was indeed persuasive in their deliberations.
