Tomson Burnham, LLC announced today it has filed a copyright infringement lawsuit (court case # 6:10-cv-06392-TC) against Ron Lee in the United States District Court for the District of Oregon. Tomson Burnham, LLC is seeking to prevent Mr. Lee from willfully copying and using original Tomson Burnham copyrighted material.
According to court documents, in 2009, Tomson Burnham, LLC created an extensive and ground breaking database of Salem area neighborhood information for its company website. This database is a unique and valuable tool for anyone looking to buy real estate in the Salem area. Tomson Burnham, LLC alleges that portions of this database began to appear on Mr. Lee's web site. Representatives for Tomson Burnham issued a cease and desist letter to Me. Lee asking he remove the material. Tomson Burnam, LLC alleges that Mr. Lee, who operates under the business name "Smart People Real Estate," continued to publish the Tomson Burnham material and the work of others as his own despite several requests.
"I'm saddened that Mr. Lee did not remove our copyrighted material from his website when requested. Unfortunately, I was left with little choice but to file the lawsuit. It is important to protect our original material and also to protect those that might be misled by Mr. Lee's improper use of our material," said Tomson Burnham, LLC owner Melina Tomson
Tomson Burnham, LLC is seeking injunctive relief to have Mr. Lee stop the alleged improper copying as well as costs and fees in the lawsuit.
