I’ll be damned if they’re going to keep a huge chunk of it. These companies delay so class members die or can’t be located, but that will not work to their benefit on my watch.
Painesville, OH (Vocus) October 27, 2010
Cleveland, Ohio law firm Dworken & Bernstein Co., Partner Patrick J. Perotti was named to the exclusive ranks of the top 75 plaintiff trial lawyers in the United States. The group, called 'Trial Lawyer Kingpins,' was chosen in a survey of defense attorneys throughout the country to identify 'the best plaintiff trial attorneys in terms of experience and influence.' The recent survey was conducted by the 1,500 attorney worldwide defense firm, Shook, Hardy & Bacon. Mr. Perotti is in respected company: the small group of 75 includes heavyweights Joe Jamail ($1 Billion Dollar Pennzoil judgment), Joe Rice and Ron Motley (National Tobacco Litigation and Liggett Master Settlement) and Stan Chesley (Beverly Hills Supper Club fire).
A question by a Shook client was the inspiration for the list. The client noted that many famous plaintiff lawyers were no longer practicing and asked, ‘who are the new heavyweights?’ Shook contacted hundreds of defense attorneys nationwide to select the top 75 plaintiff trial lawyers in the U.S. based on experience and influence. The result was a Who’s-Who of the lead lawyers in mass tort, personal injury, and class actions.
Mr. Perotti offered this comment about his selection to the group.
“Dworken & Bernstein Co. and I were not chosen for this honor because of the amount of money we recover in our cases for a single, class member. That is often small. It’s the amount of money we force the wrongdoing company to give-back at the end of the lawsuit. If they took $20 Million, I’ll be damned if they’re going to keep a huge chunk of it. These companies delay so class members die or can’t be located, but that will not work to their benefit on my watch.”
Mr. Perotti has over $100 Million in class action settlements or judgments. A Google search about him shows that he did not gain his reputation and his place among the country’s top 75 plaintiff trial lawyers from that record, but from his use of 'cy pres.' That doctrine directs unclaimed class action funds to charities. It is uniformly opposed by defendants who would rather keep unclaimed monies. Mr. Perotti is among a very small group of lawyers in the U.S. who have successfully required its use. He is noted as possibly the only lawyer in the country who has successfully required it in virtually every one of his cases. In the past few years, he and Dworken & Bernstein have distributed over $20 Million Dollars to charities throughout the country. This has earned him the label 'The Good Lawyer' from Lawyers & Settlements.com and 'an impossible bulldog' from his opponents. Mr. Perotti seems to appreciate both equally. There are many lists of ‘top attorneys.’ But being chosen to the Shook list is the gold standard, since it is selected by defense attorneys picking the 75 plaintiff lawyers and firms at the top of the profession. Having one’s opponent give you the label of the best in the country is a most prestigious and exclusive honor. It is makes me very happy to know my work is recognized this way by the defense' said Mr. Perotti.
