Ab Coaster Holdings, Inc. Files Lawsuit Against Infringer of the Ab Coaster®

Ab Coaster Holdings, Inc. announced today that it filed an action against Icon Health & Fitness, Inc. for unspecified damages seeking to protect its products, authorized dealers, and customers from infringers of its valid intellectual property.

Ab Coaster Holdings, Inc. announced today that it filed an action against Icon Health & Fitness, Inc. for unspecified damages seeking to protect its products, authorized dealers, and customers from infringers of its valid intellectual property. “We filed this case for a simple reason as it is clear Ab Coaster Holding, Inc.’s intellectual property is being knowingly and unfairly exploited,” stated Sean Gagnon, an officer of Ab Coaster Holdings, Inc.

The lawsuit, captioned Ab Coaster Holdings, Inc. v. Icon Health & Fitness, Inc. 2:10-cv-06760- SDW-MCA, was filed in United States District Court for the District of New Jersey, Newark Division and alleges that improper acts by Utah-based Icon Health & Fitness, Inc. infringe upon Ab Coaster Holdings, Inc.’s intellectual property rights. The action alleges that Icon Health & Fitness, Inc. is infringing Brown et al. United States Patent No. 7,455,633 entitled “Abdominal Exercise Machine” and Brown et al. United States Patent No. 7,485,079 entitled “Abdominal Exercise Machine.”

Ab Coaster Holdings, Inc. alleges that Icon Health & Fitness, Inc. is making, using, selling, and offering to sell a product called the “Ab Glider,” in violation of its intellectual property rights. The Ab Glider is currently marketed by Icon via retail stores throughout the United States and Ab Coaster Holdings, Inc. is taking all legal and equitable steps to ensure that Icon Health & Fitness, Inc. does not succeed with its improper activities.

According to Mr. Gagnon, “Tristar Products, Inc. (http://www.abcoaster.com), as the authorized licensee of the patents-insuit in the retail marketplace, has invested millions of dollars in promoting and advertising the Ab Coaster® product line and Icon Health & Fitness, Inc.’s actions in making and selling the Ab Glider are putting at risk the strong relations Tristar Products, Inc. maintains with its authorized dealers and customers.”

Mr. Gagnon stated, “In addition to protecting its proprietary rights, Ab Coaster Holdings, Inc. seeks to protect its dealers and customers from infringing products that are distributed illegally and in direct competition with authorized products, including the Ab Coaster®. Ab Coaster Holdings, Inc. values its vast intellectual property rights and will take all necessary action to vigorously enforce its intellectual property rights and prevent infringers from any activity in violation of its rights in order to protect the goodwill it has built with its dealers and customers.”
