Xcedex files complaint against VMware

On August 17, 2010, in United States District Court for the District of Minnesota, Xcedex Inc. filed a complaint, CASE 0:10-cv-03589-PJS-JJK, against VMware, Inc. Xcedex filed this lawsuit after its attempts to resolve the matter with VMware failed.

Thereafter, the complaint was amended by Xcedex to bring additional claims against VMware on February 21, 2011. Through its Amended Complaint, Xcedex seeks damages pursuant to the following claims:

1.    Breach of Contract;
2.    Tortious Interference with Contractual and Business Relationships;
3.    Violation of Federal Computer Fraud and Abuse Act under 18 U.S.C. § 1030(A);
4.    Tortious Interference with Contract;
5.    Misappropriation of Trade Secrets under Minn. Stat. § 325C; and
6.    Copyright Infringement.
