Tampa DUI attorney Stephen Higgins, in three separate DUI cases this week, negotiated with the State Attorney to amend all three charges to reckless driving.
In the first case, Higgins’ client was stopped for speeding. According to the arresting officer, the defendant performed poorly on field sobriety exercises, was arrested and provided a breath sample barely over the legal limit. Attorney Higgins negotiated with the State Attorney, who, on the verge of trial, amended the charge to reckless driving.
Higgins’ second case involved a client stopped for weaving and failure to maintain a single lane. The defendant consented to field sobriety exercises and was arrested. Because he had a prior offense within the past five years, he refused to provide a breath sample. Upon review of the video, Attorney Higgins negotiated with the State Attorney to amend the charge to a reckless driving, preventing his client from (1) serving mandatory county jail time and (2) losing his driving privileges for five years.
The third client of Attorney Higgins was reportedly observed by police officers driving erratically and making a wide left turn into a parking space. On video, the defendant stumbled when exiting the car but performed well on the field sobriety exercises. She later refused to provide a breath sample. On the day of trial, Higgins was able to have the charge amended to reckless driving – and the defendant was ultimately not convicted.
