Morgan Keegan Lawsuit Seeks Sanctions for Unpaid Overtime

A former administrative assistant at Morgan Keegan & Company, Inc.’s Atlanta office has filed a lawsuit in federal court in Atlanta seeking damages for its alleged failure to pay overtime wages in violation of the Fair Labor Standards Act. The lawsuit also names Morgan Keegan’s parent company, Regions Financial Corporation, which is also the parent of Regions Bank. Though the case was filed in Georgia, the lawsuit seeks certification as a collective action so the plaintiff may assert her claims on behalf of other employees who are similarly situated in all states where the defendants have offices and business locations.

Plaintiff seeks actual and liquidated damages for unpaid overtime and seeks an award of attorney’s fees and costs.

A former administrative assistant at Morgan Keegan & Company, Inc.’s Atlanta office has filed a lawsuit in federal court in Atlanta seeking damages for its alleged failure to pay overtime wages in violation of the Fair Labor Standards Act. The lawsuit also names Morgan Keegan’s parent company, Regions Financial Corporation, which is also the parent of Regions Bank. Though the case was filed in Georgia, according to the complaint, the lawsuit seeks certification as a collective action so the plaintiff may assert her claims on behalf of other employees who are similarly situated in all states where the defendants have offices and business locations.

    Plaintiff Mildred Ann Dudley claims in the complaint she was subjected to retaliatory termination for drawing attention to the fact that Morgan Keegan was not recording or paying employee overtime. According to the complaint, Morgan Keegan had a practice and pattern of requiring non-exempt employees to perform work off the clock.

    Plaintiff alleges Morgan Keegan failed to comply with the record keeping requirements of FLSA. According to the complaint, once Morgan Keegan commenced providing time sheets on which to record her work hours, Plaintiff she was instructed not to record overtime hours. Plaintiff also claims that even when the firm paid overtime wages, it violated the FLSA requirement of prompt payment of overtime wages.

    Plaintiff seeks actual and liquidated damages for unpaid overtime and seeks an award of attorney’s fees and costs. The complaint anticipates that other similarly situated employees and former employees of Morgan Keegan will seek to opt in to join the action.
