A Notary Public is a qualified lawyer that specialises in dealing with overseas transactions. In addition to dealing with foreign property documentation, notaries are able to deal with documents pertaining to all sorts of international transactions, such as visa applications, marriage licences, powers of attorney, foreign company documentation and probate. The notary works in conjunction with a client’s foreign lawyer to ensure that the documents are correctly executed and comply with the legal requirements of the country in question.
Dealing with a foreign legal system can be confusing and complicated, especially when there is a language barrier in addition to the cultural and legalistic differences. Many foreign countries require that legal documents signed in the UK for use abroad are witnessed by a notary public before the documents will be legally binding. For example, if a client is dealing with property in Spain, the usual practice is for the British citizen to give their Spanish lawyer a power of attorney to enable the lawyer to sign documents on their behalf without the client having to fly to Spain to sign the documents before a Spanish notary. Before it can be used in Spain, the power of attorney must be signed and sealed by the Notary Public and then legalised by the Foreign and Commonwealth Office.
