The fatal 18-wheeler accident attorneys of Grossman Law Offices have filed suit against Transam Trucking Inc., following their alleged involvement in a deadly truck accident. The suit (49D05-10-11-CT-048742), filed in Marion County District Court in Indiana, alleges that while within "the course and scope of his employment with Transam Trucking, Inc.," Defendant Burt Destry "operated his motor vehicle in a careless, reckless and negligent manner."
According to the suit, on or about April 13, 2009 Defendant Destry was allegedly operating his vehicle recklessly, which caused a collision between the Plaintiff Victor Rodriguez, and the Defendant's rig. Rodriguez suffered catastrophic injuries resulting from the accident.
Through the doctrine of respondeat superior, Transam Trucking Inc. is purportedly "responsible for the Defendant, Burt Destry's negligence." The suit notes Transam "had a duty to train and/or supervise their employee" and their alleged failure to do so is the "direct and proximate result of said negligence."
