The Waco truck accident lawyers of Grossman Law Offices have filed suit against Sun Coast Resources, Inc. and an employee, following the death of K. Bundy.

The suit (Cause No. AP-11-430) was filed in the 12th Judicial District Court of Leon County, Texas, and alleges the involvement of Sun Coast Resources, Inc. in the wrongful death of K. Bundy. The suit states on or about the 14th day of September, 2010, the decedent was a passenger in a van heading south on United States Highway 79. Bundy and driver J. Martin encountered an 18-wheeler operated by "an employee and/or agent of Defendant Sun Coast Resources Inc." who had allegedly "negligently reduced the speed of the Tractor Trailer to a speed lower than 15 miles per hour."

A lack of speed, coupled with the placement of the rig on an "uphill section of highway," allegedly caused the van to strike "the rear of the nearly stationary and undetectable Tractor Trailer, resulting in a fatal injury." The suit notes Texas traffic statute § 545.363, the minimum speed regulation, which states "an operator may not drive so slowly as to impede normal and reasonable movement of traffic..."

Texas 18-wheeler accident attorney Keith Purdue explains the inclusion of Defendant Sun Coast Resources, Inc. in the lawsuit. "The legal doctrine of respondeat superior allows for an employer to be found vicariously liable for the actions of their employees or agents. This is a significant and necessary doctrine, as employers should aspire to hire and train safe employees."

Waco commercial vehicle accident attorney Michael Grossman comments, "As it relates to this lawsuit, respondeat superior essentially states that Sun Coast Resources Inc. purportedly had a duty to train their employee in matters of safety. Had this training occurred, it is conceivable to believe the truck driver would have taken other actions and perhaps prevented the accident."
