After a teenaged tenant suffered a fatal mini-ATV accident on the premises of their apartment complex, the Fort Worth premises liability lawyers of Grossman Law Offices filed suit against The Hills Apartments following their alleged negligence.

According to the statement of facts from the suit (Cause No: 342-253201-11) filed in the Judicial District Court of Tarrant County, Texas, on or about October 2, 2010 a tenant of The Hills Apartments complex was "operating a mini-ATV on Defendant's premises." The tenant lost control of the ATV, then "struck a wall and sustained fatal injuries."

The suit alleges an employee of Defendant "was aware" the decedent "was operating the mini-ATV on The Hills Apartments' premises." With this knowledge, the employee of Defendant purportedly "entrusted the mini-ATV to (decedent)," "knew that (decedent) was unlicensed," and "failed to keep proper lookout for Plaintiff's safety."
Fort Worth wrongful death attorney Keith Purdue comments, "Allowing an invitee on to an owner's property heightens the responsibility that owner owes to the invitee, in this matter, the tenant. Our suit alleges that The Hills Apartments did not meet this responsibility by allegedly failing "to inspect the premises for defects" and by failing "to make safe a dangerous condition on its premises.'"
