In a recent trial, DUI defense attorneys Darren Finebloom and AnneMarie Rizzo of the law firm Finebloom & Haenel, P.A., successfully argued for acquittal of their client, who was arrested on DUI charges.
According to police reports, Finebloom and Rizzo’s client was stopped late at night by law enforcement for weaving within his lane. The Sarasota County DUI Enforcement Unit deputy asked the defendant to exit his vehicle and requested that he perform field sobriety tests. The report states that the defendant asked if he had to perform these tests, and was told by the deputy that they were voluntary. The defendant then exercised his rights and refused to perform the test. At this point during the stop he was arrested and charged with DUI. He subsequently also refused a DUI breath test.
During the trial, the deputy testified when pressed under cross by Attorney Finebloom that the purpose of the requested field sobriety tests was to determine if the defendant was impaired. The deputy admitted he did not have enough information to arrest Finebloom and Rizzo’s client prior to the refusal of the field sobriety tests. The point was then made and the deputy conceded that he arrested their client despite not obtaining any additional evidence of DUI. This concession paved the way for an effective closing argument by Attorney Rizzo.
