Boating Under the Influence (BUI) charges were dismissed recently for a client of DUI defense attorney AnneMarie Rizzo of the law firm Finebloom & Haenel, P.A.
According to court documents, the defendant was boating on a holiday weekend and the boat was stopped by the marine unit of the Sheriff’s office for traveling too fast in a manatee zone. The officers noted signs of impairment, which they believed to be due to alcohol consumption. The defendant was asked to perform field sobriety tests and was subsequently arrested. On a breath test, he blew a .21, three times the legal limit.
Court documents also show that leading up to trial, Attorney Rizzo filed a motion challenging the reliability of the breath test and the state attorney conceded that the breath test machine was unreliable. Rizzo immediately set the case for trial, believing the state had insufficient evidence to prove her client (1) was driving the boat, and (2) was under the influence. On the morning of trial, Rizzo convinced the prosecutors there was a lack of evidence and they agreed to drop the BUI charges against her client.
