Methodology - Benchmark Litigation
The guide's results are the culmination of a six-month research period in which researchers conducted extensive interviews with litigators and their clients. During these interviews the publication examined recent casework handled by the firms and asked sources to offer their professional opinions on litigators practicing within their state or national practice areas.
Regional and local expertise is a crucial factor in commercial litigation. The guide identifies the leading litigation firms and partners in each of the 50 states and the District of Columbia.
Methodology - Benchmark Appellate
The rankings and editorials cover states charted out as sub-headings within the chapters dedicated to their respective federal circuits. The guide covers all 12 circuits (the First through the Eleventh and the Washington DC/Supreme Court Circuit) as well as the Federal Circuit, which is assigned primarily to patent appeals. The guide's results are the culmination of a six-month research period that allows the guide's researchers to conduct extensive interviews with litigators and their clients. With few exceptions, such as in the event of a particularly significant state-level appeal, the main focus of the analysis is federal appeals. Although the guide does provide a comprehensive breakdown of appeals firms and attorneys within each state, due to the nature of federal appeals, some firms and attorneys may be listed in more than one circuit. Firms and litigators are ranked as leaders in the state in which the firm conducts most of its appellate work, but they may also be listed in another circuit due to a particularly notable victory attained there.
The guide divided the firms in each local market into "highly recommended" and "recommended" categories. All listed firms were consistently mentioned by peers and clients, but the "highly recommended" firms received the most mentions, and were held as dominant in their particular jurisdiction.
