On December 22, 2011, Plaintiff Dwain Landers filed a lawsuit in federal court against Safe Streets USA, LLC (formerly Alarm Team and Eversafe Security Systems, Inc.) on behalf of himself and other similarly situated employees. Landers worked as an installation technician installing home security systems monitored by ADT. He was paid a flat rate for each basic installation he did, and was not paid for the overtime hours he worked. The Complaint, filed in the United States District Court for the Eastern District of North Carolina, alleges that Landers and other similarly situated installation technicians were not paid overtime pay in violation of the federal Fair Labor Standards Act. According to the Complaint, Safe Streets is an authorized ADT Security Services, Inc. dealer and operates in twenty-six states.
Plaintiffs’ attorney Rachhana Srey stated, “these installation technicians are not exempt from the federal laws’ overtime protections. It is not fair for employers to withhold overtime pay from their hard-working employees by treating them as exempt when they are not.”
Plaintiffs are represented by Paul J. Lukas and Rachhana Srey from Nichols Kaster, PLLP in Minneapolis, Minnesota, and Seth Cohen from Smith, James, Rowlett & Cohen, LLLP in Greensboro, North Carolina.
The case was filed in the Eastern District of North Carolina and is entitled Landers, et al. v. Safe Streets USA LLC, Court File No. 5:11-cv-00749.
