Plaintiff's lawsuit was filed in the Superior Court of California for the County of Orange, Burdette v. Empire Maintenance et al Case No.: 30-2008 00113019, assigned to Judge Franz Miller. The injuries to Plaintiff, a 52 year old UPS employee, occurred when a trash bag full of tissue paper was negligently thrown on to Plaintiff's head by the janitorial company's employee causing cervical injuries. On January 3, 2007, Plaintiff, ANNE R. BURDETTE, was walking up the stairs to her workstation at UPS in Anaheim, California when an EMPIRE BUILDING & ENVIRONMENTAL SERVICES, INC., employee, while in the course and scope of her employment with EMPIRE BUILDING & ENVIRONMENTAL SERVICES, INC., was cleaning the UPS facilities. The employee of EMPIRE BUILDING & ENVIRONMENTAL SERVICES, INC., negligently threw the trash bag down the stairwell. The trash bag ,which weighed 3 to 5 lbs contained tissue paper from a restroom, struck Plaintiff on the head and neck, aggravating Plaintiff's pre-existing degenerative cervical tissue condition. Plaintiff's attorney, Alex Galindo argued that "the injury accelerated Plaintiff's eventual need to undergo cervical fusion which caused her significant pain and discomfort." The Plaintiff was unable to return to work and has since relocated to Hawaii.
