Tzunami Sues AvePoint for Acquiring Proprietary Information from Ex-Employee

Tzunami sues competitor AvePoint for hiring an ex-Tzunami employer and acquiring proprietary information and customer lists, valued in the millions of dollars


Tzunami Inc., the SharePoint Migration Masters, announced that it has filed a complaint against AvePoint Inc. for loss of trade secrets and confidential information caused by AvePoint’s hiring of an ex Tzunami employee, who was allegedly in breach of his employment contract.

Complaint no. 650305/2011, filed in the Supreme Court of the State of New York, accuses Mr. Asaf Matyas, Tzunami’s previous European Sales manager, of illegally seeking employment at AvePoint Inc., a major competitor in the data migration industry. Mr. Matyas was prohibited under his employment contract with Tzunami, from being employed in any manner with a competing business.

The motion alleges that AvePoint hired Mr. Matyas while being aware of his non-competition obligations to Tzunami. AvePoint are accused of receiving invaluable confidential information from Mr. Matyas that included Tzunami’s client lists; Tzunami’s development environment, and software code.

Tzunami are suing for damages of 5 million dollars, due to the alleged breach of confidentiality and transfer of trade secrets to their competitor.

Tzunami’s legal team is awaiting a response from the defendant.
