ThermoLife International, Inc. and its President, Ron Kramer, have filed a multi-million dollar civil action against Anthony Roberts a/k/a Anthony Connors in connection with allegedly defamatory statements made on Mr. Roberts’ blog, “The Source for Underground Steroid Information.” As alleged by ThermoLife, although Mr. Roberts purports to provide unbiased information regarding steroids and the supplement industry, Mr. Roberts’ website has intentionally and maliciously spread false information about ThermoLife’s products and ThermoLife’s President.

ThermoLife’s civil action brings claims for defamation and intentional interference with ThermoLife’s business expectancy. According to the Complaint, Mr. Roberts has posted false and defamatory information about ThermoLife’s U.S. Patent Application No. 10/904,029. The complaint asserts with evidence that, in at least four separate and distinct internet posts, Defendant falsely asserted that the patent would not and could not be issued. Defendant also contacted ThermoLife’s customers and informed them that ThermoLife’s products could not be sold under a “patent pending” label. Directly contrary to Mr. Robert’s statements, on April 5, 2011, the U.S. Patent and Trademark Office issued ThermoLife U.S. Patent No. 7,919,533.

The Complaint also asserts that Mr. Roberts defamed ThermoLife’s President, Ron Kramer, by falsely accusing Mr. Kramer of being involved with one of the biggest scandals in the history of professional sports and performance enhancing drugs, Bay Area Laboratory Co-Operative (“BALCO”). As alleged, Mr. Roberts has knowingly, recklessly, and falsely labeled Ron Kramer as a “rat.” This statement is provably false. Moreover alleged, Mr. Roberts also acted with the intention to harm Mr. Kramer’s reputation and business by fabricating other false statements, such as, Kramer “has spent the last several years setting up his friends in the bodybuilding community.” These statements are all provably false and will be proven false in a court of law.

Commenting on the lawsuit, Mr. Kramer stated: “Anthony Connors (a/k/a Anthony Roberts) clearly has an agenda and it has nothing to do with reporting the truth. This lawsuit sets an industry wide precedent that profane discourse and false statements about ThermoLife International will not be tolerated. Anyone following the same path as Anthony Roberts in the future will find themselves served with court papers.”

ThermoLife has retained trial attorney Gregory B. Collins, from the law firm Kercsmar & Feltus, PLLC in Scottsdale, Arizona. Mr. Collins has successfully handled many internet defamation cases. Addressing ThermoLife’s claims, Mr. Collins stated, “With the popularity of internet blogs, the internet has become the bastion of smear campaigns and slander. The pending litigation against Mr. Connors was assigned Case No. CV2011-051273, filed 4/19/2011 in The Superior Court of The State of Arizona, in and for The County of Maricopa.
