Bohn & Bohn Set to Commence Litigation in Wrongful Death Lawsuit on Behalf of Achilli Family Survivors

San Jose wrongful death attorneys pursuing civil damages from four men convicted of 2008 murder of popular Los Gatos restaurant owner

Attorneys from the San Jose law firm of Bohn & Bohn, LLP are ready to pursue their wrongful death lawsuit against four men convicted in the murder-for-hire killing of Los Gatos restaurant owner Mark Achilli in 2008.

Achilli, the former owner of the 180 Restaurant and Lounge and Mountain Charley's saloon in downtown Los Gatos, was gunned down outside his home on the morning of March 14, 2008. According to a criminal complaint filed on April 2, 2008 (Santa Clara County v. Garcia, et al, Case No. CC800985), Esequiel "Paul" Garcia, who bought the restaurants from Achilli in 2007, was arrested in connection with the murder, along with Daniel Chaidez and his cousins, Miguel Chaidez and Lucio Estrada.

Wrongful death attorneys at Bohn & Bohn are representing Achilli’s widow, Michele, and his daughter, Alexandra, in the civil litigation. The lawsuit alleges negligence, assault, battery, and intentional and willful misconduct against each of the defendants and seeks an unspecified amount of money in damages.

The civil complaint, Achilli v. Garcia, et al (Case No. 110CV166426), was actually filed in the Santa Clara County Superior Court last year in order to protect the survivors’ legal rights under the statute of limitations. However, the civil litigation was unable to proceed while the criminal cases against the co-defendants were in progress.

In the murder trial last fall that was held in the Superior Court of California for the County of Santa Clara, prosecutors alleged that Garcia asked Daniel Chaidez for his help in arranging for the murder of Achilli, gave him $9,500 to do the job, and that Miguel Chaidez then contacted Estrada and offered him money to get rid of Achilli. All four men were convicted last fall and three of them have been sentenced to lengthy prison terms. Garcia, the mastermind behind the murder, will be sentenced in September. With the criminal matters largely resolved, the civil litigation can now proceed in earnest.
