The managing partner of The Wright Firm, L.L.P. recently spoke at Argosy University in Dallas on expert testimony in depositions and trial. Board certified in family law by the Texas Board of Legal Specialization, a distinction shared by fewer than ten percent of the state’s lawyers, Patrick A. Wright is already an expert in his own right.
“As a trial lawyer, I am in court each and every day questioning counselors, psychologists, and psychiatrics,” Wright explains. “There is a certain skill that a lawyer must have when questioning experts considering that less than five percent of cases actually go to trial in Texas.” “Some lawyers try to limit their practice to collaborate law or uncontested divorce,” according to the Lewisville child custody attorney. “As a practicing Texas family law trial attorney, it was interesting to be the one questioned by the psychologists and students.”
The program at Argosy was a rare experience for psychologists, students, and counselors to actually question lawyers about the reasons why lawyers ask certain questions in depositions or trials. “There was an amazing exchange between the psychologists and the lawyers at the conference,” Wright explains. In divorce and family law cases, many times the expert gets to only answer the questions that the lawyers ask in court. Many of these answers focus on the conflicts between the law and the ethics that a psychologist or counselor must follow when participating in a child custody case and in writing their evaluations.
In divorce cases in Texas, the court may order in a custody case that a social study be completed to evaluate the parties, the children, and the home where the children may reside. Wright who has spent the last seventeen years trying, settling, and working on child custody cases explained to the conference participates how an attorney can deconstruct their reports and how clients feel about the reports that are produced in a child custody evaluation. Wright explained to the conference attendants, “To many of the individuals who are in a family law custody case, they are looking to the expert to be fair, listen to their concerns, and do what is right and in the best interest of their children.”
