Hartline Dacus Partner Brian Rawson Wins Unanimous Defense Verdict

This one-day jury trial in Tarrant County, Texas concluded when the jury returned a unanimous defense verdict in less than 10 minutes.

Hartline Dacus Barger Dreyer LLP today announced that Brian Rawson, a partner in the firm's Dallas office, recently obtained a unanimous defense verdict on behalf of his client, a well-known Fortune Global 500 company, in a negligence case in which the plaintiff claimed to have sustained various physical and emotional injuries. This one-day jury trial in Tarrant County concluded when the jury of three men and three women returned a unanimous defense verdict in less than 10 minutes.

"When the jury returned a unanimous verdict in such a brief time period, it reinforced my belief that this case was without merit," said Mr. Rawson. "It’s imperative that companies fight to protect their reputations against these kinds of frivolous claims."

The case arose from an automobile accident in which the plaintiff, a 37-year-old accountant, alleged that an 18-wheeler tire fell from a trailer while traveling on a highway and struck her vehicle at a high rate of speed, causing neck, back, shoulder, and knee injuries. The plaintiff was three months pregnant at the time of the accident and also claimed the collision caused her stomach to strike the steering wheel. Although her child was born without any complications, the plaintiff claimed she suffered great emotional stress worrying about his wellbeing for six months before she gave birth.

The defendants in the case denied the plaintiff actually suffered any of the injuries she claimed. Mr. Rawson successfully argued that the impact was not significant enough to cause any injuries. The plaintiff waited a week before visiting a chiropractor and did not visit a medical doctor for any of her injuries.

Mr. Rawson is a member of the Defense Research Institute and his practice focuses on product liability defense for vehicle and automotive equipment manufacturers, as well as catastrophic personal injury and wrongful death cases. His clients include General Motors and a number of other large corporations in the motor vehicle industry. Earlier this year, Mr. Rawson and his colleagues at the firm won a defense verdict for GM in a high-profile product liability case, notable for being the first such trial for GM following the company’s recent emergence from bankruptcy.
