Applied Food Sciences, Inc. has favorably concluded a patent dispute with Dajomi Brands, LLC, the former marketers of NOHO "The Hangover Defense"™ shot, that required Dajomi to cease making and distributing the products that allegedly infringed Applied Food Sciences, Inc.'s patent.

Applied Food Sciences, Inc. brought a lawsuit, case 1:2010cv00767, in the United States District Court for the Eastern District of Texas against the former marketer of NOHO™, stating they were infringing its patent for the use of glucarate and its derivatives such as glucuronolactone, a popular ingredient in energy drinks, for the reduction of negative symptoms associated with alcohol ingestion. U.S. Patent No. 7,662,863.

A U.S. District Judge issued a final judgment and permanent injunction against Dajomi Brands, LLC. The validity or enforceability of the patent was not disputed by Dajomi Brands, LLC. The defendant was enjoined from making, using, offering to sell, selling, or otherwise distributing within the United States, or importing into the United States, infringing products.

“This judgment further validates the value of our technology and demonstrates that we will vigorously enforce our rights under the patent. We are interested in partnering with other marketers of detoxification products but we want them to properly license our technology if they want to make claims related to hangover prevention." said Loretta M. Zapp, Applied Food Sciences, Inc.'s CEO.

Applied Food Sciences, Inc.'s patent covers several ingredients and products, including their own product, GTOX® Hangover Shot which is specifically formulated for preventing hangovers. Austin, Texas-based Applied Food Sciences is a health and wellness organization that specializes in providing nutritional solutions for the food, beverage and supplement industries.
