With the tenth anniversary of the 9/11 terrorist attacks almost here, the New York personal injury lawyers at Barasch McGarry Salzman & Penson are anxiously awaiting the findings of the soon to be released Fire Department of New York (FDNY) health study. The seven-year federally funded study has been tracking illnesses and deaths among firefighters who worked at or near Ground Zero. The Fire Department’s chief medical officer Dr. David Prezant reportedly discussed the rise in post-9/11 firefighter cancer rates in several meetings this spring, but has not formally released the study. It is expected out in the next few days.

When that fund was discontinued in 2004, it left thousands of ineligible WTC firefighters, workers and family members without financial recourse as they fell ill over time from slow-acting toxins. Barasch says the firm has been lobbying the new Zadroga Act, not only for it to include additional illnesses/diseases, but to permit compensation to former VCF recipients whose health has deteriorated since their initial awards six years ago.
“The Zadroga Act will provide medical and financial aid to thousands of people who have suffered as a result the terrorist attacks, but who weren’t eligible to apply before,” Barasch said. “However, although the rate of leukemia and other blood cancers is reportedly rising in WTC firefighters after 9/11, these were not included in the list of illnesses covered in the Zadroga Act. My hope is that the FDNY health report substantiates these findings strongly enough to have the new diagnoses added to the list.”
The September 11th Victims Fund set up after 9/11 had a very narrow in scope, with eligibility limited to first responders, Barasch explained. The James Zadroga 9/11 Health and Compensation Act is intended to provide health care and compensation to those suffering from exposure to toxic substances at Ground Zero during the days, weeks and months after the initial disaster. The Zadroga Act includes a list of ailments such as chronic lung and respiratory disorders, asthma, back problems, and “a variety of cancers as determined by the WTC Administrators based on medical evidence including studies by hospital programs treating first responders,” as stated in the Act. Currently absent from that list are the blood-related cancers that the FDNY health study has reportedly uncovered.
The James Zadroga 9/11 Health and Compensation Act is named for the former NYPD detective James Zadroga, who died of respiratory disease as a result of his work at the World Trade Center Site. It was passed by Congress and signed into law in December 2010. His case became a symbol for the thousands of Ground Zero workers who developed chronic or fatal illnesses as a result of their dedication to recover the fallen at the Ground Zero site.
