Through agency law, our lawsuit includes the owners of the trucks and alleges that had their employees been properly trained, this accident could have been prevented.
Texas (PRWEB) January 13, 2012
Following a fatal 18-wheeler accident, the Texas truck accident lawyers with Grossman Law Offices have filed suit, alleging Defendants' negligence in the incident.
Filed within the office of Circuit Court Dade County Civil Division, lawsuit number 10-64251CA20 alleges on or about January 7, 2010, a tractor trailer driven by an employee of Defendant PH WASTE "unlawfully stopped said vehicle on the East shoulder of the roadway partially obstructing the outside lane..." Shortly thereafter, an employee of both A.R. LANDSCAPING and AFLC also "unlawfully stopped and parked said vehicle partially obstructing the outside lane..."
According to the suit, Defendants' alleged position on the roadway, "obstruct(ed) the outside lane causing Mr. Griffiths' vehicle to collide" with Defendant PH WASTE's vehicle. The suit then states the victim's truck overturned and struck Defedants' A.R. LANDSCAPING and AFLC truck, "coming to final rest" in the inside lane of the roadway.
Bryan 18-wheeler accident attorney Keith Purdue comments, "When a tractor trailer becomes disabled or stopped in the traveled portion or shoulder of a highway, the Federal Motor Carrier Safety Regulations requires that certain safety measures be employed. Namely, hazard warning signal flares, warning devices, fusees and liquid-burning flares, among other actions, are to be used in order to alert on-coming drivers of the dangers ahead."
Lawyer Keith Purdue continues, "Through agency law, our lawsuit includes the owners of the trucks and alleges that had their employees been properly trained, this accident could have been prevented."
