The tragedy of a car full of teens being killed with a young driver at the wheel is all too common.
As reported by the Huffington Post, on October 8, 2012 five teenagers were riding in a car driven by the youngest of the group, 17-year-old Joseph Beer. At 4 am Monday, Beer – who was driving with a learner’s permit -- missed a corner at the Southern State Parkway near Exit 17. The corner is so notorious for accidents that emergency responders in the area have nicknamed it “Dead Man’s Curve.” All four 18-year-old passengers were killed when the car hit a tree with such force that it split in two. The only survivor was Beer, who was found stumbling near the edge of the parkway.

According to the NY Times, local residents said the road climbs a steep hill before veering sharply. Pasquaule Luongo, who lives near the scene of the accident said, “They probably should have something that gives a little more warning.”
“Just because the driver may not have been following all the requirements of driving on a learner’s permit would not absolve the state of all responsibility,” commented Fogel. He said, “In an accident such as this, it is quite possible the State could also bear some responsibility if there were no proper warnings before this dangerous curve.”
