Tampa, FL (PRWEB) October 18, 2012
DUI firm Thomas & Paulk recently represented a client in a case involving charges of DUI with property damage (Hillsborough County Court, Case No. 5080-XGA). According to court documents, the client had been charged for drunk driving after being involved in a crash with two marked Hillsborough County Sherriff’s patrol vehicles. The deputies had been investigating another unrelated accident at the time of this crash. Their client sustained injuries in the crash; per court documents, the Deputies noted the scent of alcohol before the client was sent to receive medical treatment at a local document.
According to court documents, the Deputies investigated further, going to the hospital and requesting a blood sample from the client. The results of the blood test returned one month later and, according to the court documents, showed the client had blood alcohol concentration of 0.174 percent. The client was charged for DUI with property damage; at this point, the legal team at Thomas & Paulk was brought into the case. The firm immediately reviewed the case and discovered that the charging document had not been properly completed. The case was set for jury trial; at the pre-trial date, the firm successfully got charges reduced to reckless driving.
Cases of DUI charges are complex; due to this, many of the accused will avoid fighting them because they simply believe that there is no chance that they will ever be able to overcome any evidence held against them. At Thomas & Paulk, however, they strongly believe that the State has the burden of properly charging cases. Should the State make any procedural mistakes, it can be utilized by defense lawyers to seek justice on behalf of the accused. Therefore, it is extremely important that those who have been criminally accused of drunk driving do not hesitate to consult with a knowledgeable attorney as soon as possible. There may be details that could result in a resolution of a case that were not thought possible.
