The Consumer Justice Foundation hereby alerts the public that a Depakote birth defects lawsuit has been filed against Abbott Laboratories in Illinois, and this lawsuit seeks the recovery of damages because the children of mothers involved in this lawsuit allegedly were born with birth defects because their mothers used Depakote while pregnant.
Specifically, this lawsuit was filed on September 6, 2012 in the St. Clair County Circuit Court in Illinois. It was assigned a case number of 12-L-462 and the named plaintiff is Susan DeMatteo. According to the court documents, the named plaintiff is one of more than a dozen mothers who are alleging that their children were born with severe birth defects as a result of using Depakote during the early stages of their pregnancies.
The court documents indicate that the children who were allegedly harmed as a result of Depakote side effects suffered from birth defects that included spina bifida, neural tube defects that led to other complications and several less severe birth defects. The basis for this allegation that’s present in these documents is that the active ingredient in Depakote, valproic acid, is known to cause harm to the unborn children of mothers who ingest it.
The court documents go on to allege that the defendant, Abbott Laboratories, was negligent both in the manufacture and in the distribution of this product, which is used as an anticonvulsant to help with symptoms associated with epilepsy and migraine headaches. The plaintiffs are seeking damages that would compensate them for their medical costs past and future, their past and future loss of income and their court costs.
