Gilman Law LLP reports that an agreement has been reached between attorneys for Plaintiffs and Defendants in the DePuy Orthopaedics, Inc. Pinnacle Hip Implant Products Liability Litigation (“MDL No. 2244”) regarding the contents of a communication DePuy will issue to notify hospital and surgeons of an explant protocol established in conjunction with a U.S. Food & Drug Administration-mandated metal-on-metal hip implant study. According to a September 13 Order from U.S. District Court Judge James E. Kinkeade of the U.S. District Court, Northern District of Texas, DePuy is now permitted to send the agreed-upon notification of the post-market surveillance study to its list of hospitals and surgeons.

DePuy and 20 other manufacturers of metal-on-metal hip implants were ordered by the FDA to conduct such studies in May, amid concerns that the wearing of microscopic bits of metal debris from metal-on-metal hip replacement devices can cause premature implant failure and long-term health problems. According to the FDA, is known that over time, the metal particles shed by metal-on-metal hip implants can cause damage to bone and/or tissue surrounding the device and joint, resulting in adverse local tissue reactions. The agency is also concerned that some studies have found that high levels of metal ions shed from metal-on-metal hip implants into the blood stream may cause symptoms or illnesses elsewhere in the body, including effects on the heart, nervous system, and thyroid gland.

The federal litigation involving the metal-on-metal DePuy Pinnacle hip implant is moving forward quickly. In another Order dated August 14, Judge Kinkeade directed that the litigation’s first bellwether case should be ready for trial by September 4, 2014.
