U.S. District Judge Robert Chambers on Sept. 25, 2012, ruled that 18 cases filed by minors alleging they suffered injuries from Zoloft must be heard in Wayne County Circuit Court, the West Virginia state court where they were first filed in July 2012, according to LegalNewsline.com. The plaintiffs in the 18 cases come from 16 different states, including West Virginia, according to LegalNewsline.com, and Pfizer, Zoloft’s manufacturer, wanted the cases transferred to a multidistrict litigation (MDL) proceeding in Pennsylvania.
Judge Chambers’s opinion stated that the existence of an MDL did not undermine his ability to consider a remand motion, LegalNewsline.com reports. "Defendants have not met their burden of demonstrating that Plaintiffs' claims were not properly joined because of case processing practices in Wayne County Circuit Court," he wrote, ruling that because the claims were properly joined in the West Virginia state court, they are subject to state jurisdiction, according to LegalNewsline.com.
