Biomet Hip Implant Lawsuits Ordered Consolidated in Indiana Federal Court for Pre-Trial Proceedings

All Federal Biomet hip implant lawsuits involving the metal-on-metal Biomet M2a Magnum Hip Replacement System will be consolidated in the U.S. District Court, Northern District of Indiana, Bernstein Liebhard LLP reports.

A panel of federal judges has ordered that all Biomet hip implant lawsuits involving the Biomet M2a Magnum Hip Replacement System be consolidated in the U.S. District Court, Northern District of Indiana, for pre-trial proceedings. In a Transfer Order dated October 2, 2012, the U.S. Judicial Panel on Multidistrict Litigation (JPML) tapped the Honorable Robert L. Miller to preside over the litigation. According to Bernstein Liebhard LLP, the new litigation is entitled In re: Biomet M2a Magnum Hip Implant Products Liability Litigation - MDL No. 2391.*

The Biomet M2a Magnum Hip Implant is a metal-on-metal hip replacement system. The Panel also noted that it had been notified of 57 additional, potentially related actions. All of the complaints share similar allegations that the metal-on-metal design of the Biomet hip implants has a propensity to generate high levels of metal ions, cause metallosis in the surrounding tissue and/or fail prematurely. Two plaintiffs had petitioned the Panel for centralization in either the Northern District of California or the Southern District of New York, while two others moved for the Eastern District of Louisiana. Biomet had opposed consolidation. In choosing the Northern District of Indiana as venue, the JMPL noted the closeness of Biomet’s headquarters in Warsaw, Indiana.

The new Biomet hip implant litigation is just one of several metal-on-metal hip replacement MDLs established by the Panel, according to Bernstein Liebhard LLP.
