NuvaRing is a once-a-month vaginal contraceptive ring that was touted as a convenient birth control choice for young women. Last October, results from an FDA-funded study that involved 800,000 American women using some form birth control between 2001 and 2008 revealed NuvaRing increased the risk of blood clots, including deep vein thrombosis and pulmonary embolism, by 56% in comparison to older birth control pills. Most recently, research published in The New England Journal of Medicine in June found that women who used combined hormonal devices, such as NuvaRing, as much as 3 times more likely to experience heart attacks and strokes compared to women who used other types of hormonal birth control.

Court records indicate that some 800 lawsuits are now pending in the Eastern District of Missouri alleging NuvaRing increases the risk that a young woman will experience life-threatening blood clots, including deep vein thrombosis and pulmonary embolism, as well as hearts and strokes. According to Judge Sippel’s Case Management Order #1334 issued on August 23, 2012, Prather v. Organon will be among the first of three NuvaRing lawsuits to go to trial. Defendants and Plaintiffs will each select one additional NuvaRing lawsuits from a pool of potential cases for the second and third bellwether cases. According to Alonso Krangle LLP, these test trials will help evaluate the strength of plaintiffs’ claims and gauge how juries might rule in similar NuvaRing lawsuits.
An additional 125 NuvaRing lawsuits are pending in a Mass Tort proceeding in New Jersey Superior Court, Bergen County. According to Court records, the first trial in that litigation is scheduled to begin in February 2013. (Docket No. BER-L-3081-09)
