The premier nationwide law firm of Wright & Schulte LLC, and leading Ohio personal injury law firm has filed a Skechers Shape-Ups injury lawsuit on behalf of an Alabama woman who broke her foot in three places and later suffered a torn tendon, allegedly due to her use of Skechers Shape-Ups toning shoes. The Skechers torn tendon lawsuit, which was filed on September 28, 2012, in the Skechers Toning Shoe Product Liability Litigation (MDL 2308) now underway in U.S. District Court, Western District of Kentucky, names Skechers USA Inc., Skechers USA Inc., II, and Skechers Fitness Group as Defendants. According to the Complaint, the Plaintiff was found to have broken her left foot in three places after she fell in October 2010 while wearing her Skechers Shape-Ups toning shoes and walking on a flat surface in her front yard. Then in May 2012, she sustained a torn tendon in her left ankle, again while wearing the Skechers toning shoes and walking on a flat surface. In both instances, the Skechers Shape-ups toning shoe pronated inward, suddenly and without warning, and caused her left ankle to collapse, and causing her to fall in excruciating pain. As a result of her injuries, the Plaintiff was forced to wear a boot on her ankle for several weeks, and to undergo surgery have to her torn tendon repaired. The lawsuit alleges that the Plaintiff suffered harm, damages and economic loss and will continue to suffer such harm as a direct and proximate result of her use of Skechers Shape-Ups.
The complaint claims that Skechers Shapes-Ups produce a substantial risk of causing chronic injuries and inducing falls due to their elevated and unstable rocker-bottom sole, which alters gait mechanics and creates instability. Among other things, the lawsuit points out that Consumer Reports documented as of May 2011 that Skechers has seen more reports of injuries or complaints than any other product in its database. The complaint also notes that an independent study commissioned by the American Council on Exercise concluded that “there is simply no evidence to support the claims that these shoes will help wearers exercise more intensely, burn more calories or improve muscle strength and tone.” The Plaintiff alleges that had she known that Skechers Shape-Ups toning shoe provided no benefit to her health, she would not have purchased or worn the shoes and would not have incurred the injuries or damages she did as a result of her use of the shoes.
