Lawyers at Roeser Bucheit & Graham LLC obtained judgment on behalf of Defendant Sandra Pilarski in the case David Sorenson v. Sandra Pilarski, Case No. 09-CH-2208 (Circuit Court Lake County, Illinois). The plaintiff, Lake Forest resident David Sorenson, sought over a $1 million in damages in connection with the lawsuit he filed against Pilarski in 2009.
On October 17, 2012, Presiding Judge Diane E. Winter entered final judgment against Sorenson and in favor of Pilarski. Judge Winter denied Sorenson’s claims for damages, including his million dollar claim for defamation and his over $300,000 claim for replevin. In addition, Judge Winter found in favor of Pilarski on her counterclaims against Sorenson and awarded Pilarski over $65,000 in damages.
Pilarski's attorneys say that they aggressively defended against the claims at trial. They argued at trial that it was Sorenson that engaged in misconduct by forging or otherwise altering company checks for his own benefit, diverting funds intended for an investment account to his own personal accounts, forging Pilarski’s signature to purchase luxury automobiles, and breaching his fiduciary duties. The Court ultimately found in its trial order that Sorenson’s explanation of certain events to be “without support and not credible.” (Trial Order Par. 24.) The Court concluded that Sorenson altered multiple checks by increasing the amounts on the check, which Sorenson was not entitled and that he was not authorized to write other checks. (Trial Order Par. 26-28.)
The court entered judgment in favor of Pilarski on her claims for breach of fiduciary duty, conversion, and constructive trust.
