Kaneka Corporation (“Kaneka”) filed suit against Sinochem Jiangsu Co. Ltd (“Sinochem”) and Sinochem American Holdings Inc. in the United States District Court for the Central District of California (Case # CV 09-07290/GHK (SSX)), alleging infringement of U.S. Patent No. 7,145,044, which covers methods of producing reduced Coenzyme Q10 (Ubiquinol) using solvents with high oxidation-protective effects. Sinochem American Holdings Inc. was dismissed from the suit on April 14, 2011.
Kaneka and Sinochem have reached a settlement of this case, pursuant to which Sinochem has acknowledged the validity, enforceability and infringement of the ‘044 Patent, has agreed to entry of an injunction preventing the sale by Sinochem of reduced Coenzyme Q10 (Ubiquinol) products within the United States, and has agreed to refrain from marketing, importing, using, offering for sale or selling such products within the United States during the remaining term of U.S. Patent No. 7,145,044, which expires on September 12, 2022.
Under the terms of the agreement, other details of the settlement remain confidential.
