Lawyers Urge Hurricane Victims to Seek Compensation

The damage wrought by Hurricane Sandy includes property damage, injuries, and loss of life. But attorneys with New York Accident Lawyers say insurance claims will not always be sufficient – and victims may be owed more.

Hurrican Sandy's devastation is still being surveyed. While citizens struggle to return to their normal daily lives with continued interruptions to wi-fi, power and cellphone service, authorities place the death toll at 38 as of Thursday reported the NY Times. But while the total damage to property and loss of life remains to be seen, attorneys with New York Accident Lawyers, a group that offers free assistance to victims, warns that insurance will not cover all of it.

“Insurance companies are overwhelmed,” said Jody Adkins, a spokesperson for the group. “And as always, their motivation is to minimize what they have to pay out. I would expect claims to be delayed, and many won't pay nearly what people need.”

The group's website provides legal advice and helps accident victims find lawyers who can help them take legal action if needed. All of the attorneys who work with the site offer free consultations.

“We created the website because so many victims feel like they have nowhere to turn,” Adkins said. “They're not sure what their legal options are, and they're afraid it will cost too much to talk to a lawyer. Our job is to make it accessible.”

Adkins says insurance companies are often slowest to pay claims after a disaster, because they have so many claims coming in at once. But she believes the slowdown can harm victims. “They'll use the delays to put off your claim more and more. Sometimes, a letter from a lawyer is enough to get them moving.”

She expects that claims following Hurricane Sandy will include property damage as well as medical claims, and in some cases, there could be liability issues.

“Obviously things will never go smoothly in the chaos of a hurricane, but that doesn't excuse negligence, neglect or faulty equipment. Anyone who was injured may have a legal right to compensation. We always recommend talking to a lawyer, especially if you have hospital bills to pay.”
