In addition to the C.R. Bard transvaginal mesh litigation, four additional pelvic mesh proceedings are currently underway in the Southern District of West Virginia before Judge Joseph R. Goodwin. Since 2008, the U.S. Food & Drug Administration (FDA) has been reviewing the safety of transvaginal mesh products used in the surgical repair of pelvic organ prolapse (POP) and stress urinary incontinence (SUI). On October 20, 2008, the agency issued a Public Heath Notification advising it had received more than 1,000 complaints over a three year period relating to transvaginal mesh products. In a second Public Health Notification issued on July 13, 2011, the FDA noted that it had received a total of 2,864 reports of complications between 2008 and 2010. The agency concluded that serious injuries associated with surgical mesh for transvaginal repair of POP, were “not rare,” and further advised that transvaginal POP repair with mesh “does not improve symptomatic results or quality of life over traditional non mesh repair.” [http://www.fda.gov/MedicalDevices/ProductsandMedicalProcedures/ImplantsandProsthetics/UroGynSurgicalMesh/default.htm
Additional transvaginal mesh lawsuits have also been filed in state courts throughout the U.S. According to Bloomberg News, a California jury in July awarded $5.5 million to a woman who claimed to have suffered serious injuries from a C.R. Bard transvaginal mesh device. The first bellwether trial in the federal C.R. Bard litigation underway in West Virginia is scheduled to begin on February 5, 2013, Bloomberg reported.
