Changes Will Affect Drivers Seeking To Restore Licenses

On his license reinstatement blog, Attorney Mark Langschied recently discussed the revamped forms and processes for driver’s license restoration in Michigan. Some of these changes are significant and will require more paperwork to be filled out, especially for Michigan residents.

Individuals seeking to reinstate their driving privileges following drunk driving convictions will need to submit an eight-page Request for Hearing and Substance Use Evaluation. The Request for Hearing contains six pages of questions and an Evidence Affidavit, which must be signed and dated by the petitioner. In the past, only those seeking an Administrative Review were required to fill out an affidavit and submit the documents by mail to the Secretary of State for review.

Michigan driver’s license appeal petitioners must also fill out an Evidence Affidavit to verify that all evidence has been submitted. In the past, only those requesting video hearings were required to fill out the form. Whether or not hearing officers will accept additional documents at the hearing will most likely be determined on a case-by-case basis.

“The new forms appear to limit whom is permitted to request an Administrative Review by mail,” said Michigan driver’s license attorney Mark Langschied. “According to the new Request for Hearing, only non-Michigan residents attempting to clear their driving record are eligible for Administrative Reviews.”

An evaluation by a licensed substance abuse treatment center is also required for driver’s license reinstatement in Michigan. Previously called the Substance Use Disorders Evaluation, this form is now referred to as the Substance Use Evaluation and appears to be identical to the old form with the exception of the title change.
