The law firm of Siprut PC has secured a settlement with Southwest Airlines in the firm’s long-standing, nationwide class action against Southwest Airlines over Southwest’s decision to stop accepting Business Select drink vouchers in 2010. The lawsuit (In Re: Southwest Airlines Voucher Litigation, Case no. 1:11-cv-08176, Northern District of Illinois) alleged that Southwest breached a contract with consumers when Southwest declared in August 2010 that it would no longer accept Business Select vouchers without a printed expiration date, and retroactively voided all previously issued vouchers.
The settlement constitutes a complete and total victory for the Class, as Class members are permitted to receive replacement vouchers for each voucher they were previously issued and never redeemed. Given the number of unredeemed vouchers in circulation when Southwest began refusing to honor them, the settlement fund necessary to honor all claims is between $29 million and $58 million. The settlement also requires Southwest to print clear and conspicuous expiration dates on future vouchers, and to honor those dates.
