The national products liability law firm of Wright & Schulte LLC has filed a Skechers Shape-Ups injury lawsuit on behalf of a Niles, Ohio, woman who fell and suffered a left orbital fracture, allegedly due to Skechers toning shoes. The lawsuit, which was filed in the Skechers Toning Shoe Products Liability Litigation (MDL 2308) now underway in U.S. District Court, Western District of Kentucky, names Skechers USA Inc., Skechers USA Inc., II, and Skechers Fitness Group as Defendants (3:12-cv-00674-TBR).

This new lawsuit is just one of dozens now pending in the Skechers toning shoes multidistrict litigation in the Western District of Kentucky before U.S. District Judge Thomas B. Russell. Richard W. According to her lawsuit, the Plaintiff was walking on a flat surface in a parking lot on November 25, 2010. Suddenly and without warning, one of her Skechers Shape-Ups toning shoes rolled forward and caused her to fall, resulting in unconsciousness and then excruciating pain. Ultimately, the Plaintiff was diagnosed with a left orbital fracture. As a result of her injury, the complaint alleges she has incurred, among other thing, significant medical expenses, possibly future medical expenses, pain, mental anguish and lost wages. Additionally, she alleges that she is at increased risk for future health problems and disability

The Plaintiff alleges that after seeing many television and print advertisements touting the benefits of Skechers toning shoes, she was lulled into purchasing a dangerous product that the Defendant knew produced a substantial risk of causing chronic injuries and inducing falls. According to the lawsuit, Skechers Shape-Ups’ rocker bottom soles are designed to create instability and to change gait mechanics, which can and does cause chronic injuries. The complaint further alleges that the health risks of Skechers outweigh the absence of any benefit provided to the wearer.
