On December 29, 2012, Rapid Recovery Solution responded to a Legal Newsline article regarding a West Virginia Attorney General going after three collection agencies for unlawful debt collection.

According to the Legal Newsline article, “West Virginia Attorney General Darrell McGraw announced subpoena enforcement action filings against three companies for allegedly unlawful debt collection activities.” The article states that McGraw received complaints and other information about the collection agencies that indicated these firms were using illegal collection practices to collect debts.

According to McGraw, “The use of investigative subpoenas may be the most important tool we have to uncover violations of the law and to determine whether to bring enforcement actions when necessary to protect consumers.” The article states that McGraw issued subpoenas to each agency, and if they do not comply to the subpoenas, subpoena enforcement actions are taken.

According to the article, “McGraw was given the authorization to offer investigative subpoenas by the state legislature as a means of obtaining documents and other information when his office has reason to believe that a person or company is in violation of state consumer protection laws or to make sure that they are not.”
