KCPQ Channel 13’s Dana Rebik interviewed Seattle family law attorney Eric Engel of the Engel Law Group on Tuesday, February 7th as an expert in family law matters. Eric was asked to give an opinion about Josh Powell’s controversial home visit that ended with the death of Powell and his two sons.
According to numerous media reports (including KCPQ Channel 13), a social worker from the Department of Social and Health Services (DSHS) supervised the home visit, and was locked outside when Powell allegedly attacked his children with an ax, then killed himself and the two boys by setting off an explosion inside the home. While the visit’s ending was shocking and tragic, Engel commented in the interview that the decision to allow home visitation visit in Powell’s case was shocking itself.
“It’s very rare. I haven’t seen it in hardly any of my cases,” said Engel.
When a parent loses custody, supervised visits are almost always at a neutral site like an office, mall or restaurant, explained Engel. There is only one situation in a child custody case, says Engel, when the court may allow home visitation.
“If you’re going to go from neutral visitation to home visitation, there’s going to be a swing to where one parent is going to get custody back, but given what I know about this case, that wasn’t going to happen at all,” Engel said.
