The U.S. Equal Employment Opportunity Commission (EEOC) seems to be making more favorable determinations for Complainants in this area. In a recent case, the EEOC determined that an Agency discriminated an employee on the basis of age. In this case, the Complainant was 58 years old and worked for the Agency as a Service Representative since 1998. He applied and was not selected for a Social Insurance Specialist position. The three selectees were all much younger. One of Complainant’s co-workers credibly testified that she often went to Complainant for technical assistance. In addition, one of the selectees had extremely limited work experience, and another selectee had no experience at all. After reviewing all of the applications, and determining that the Complainant did not have a four-year degree, the selecting official added the criterion of a four-year college degree. The EEOC found his nonselection was discriminatory due to age and ordered the Agency to offer the Complainant the same or comparable position, with appropriate back pay and benefits, retroactive to the date of the hire of the selectees.
