Eisenberg & Associates are investigating unintended pregnancies due to Glenmark’s recall of birth control pills due to defective packaging. The recall is of Norgestimate & Ethinyl Estradiol birth control pills. (A similar recall was previously announced related to Pfizer & Qualitest birth control pills.)
Birth control pills containing hormones are intended to be taken once a day but for seven days of each month placebo sugar pills are taken. The defective packaging caused an improper amount or sequence of hormone and placebo pills to be included in each monthly supply. This means that patients would have ineffective contraception and could become pregnant.

“It is hard to believe that Glenmark did not have proper quality control safeguards in the drug manufacturing and packaging process”, said attorney Larry Eisenberg. “Women could be compensated for unintended pregnancies which could include expenses related to raising the child, emotional distress, medical expenses and loss of earnings during and after the pregnancy”, said Eisenberg. “It is a foregone conclusion that many women will be emotionally distraught that they could or have become pregnant due to a manufacturing error”, said Eisenberg.
