Paying for Canadian Immigration Advice Pays Off, Statistics Prove: Transcend Consultants

According to Transcend, the empirical data released by CIC and shared by Lexbase show a clear correlation between the success of applications when the Applicants considering Canada for immigration under certain categories use a paid.

Paid representative in immigration system of Canada are those who provide advice, representation or assistance at any stage of an Immigration application, for a fee. Referred to as 'Authorised Representatives', these are:

• Lawyers in Canada;
• Regulated Immigration Consultants anywhere in the world, registered with the Immigration Consultants of Canada Regulatory Council (ICCRC);
• Paralegals in Ontario.

The CIC website states that there's no special attention or guaranteed approval of an application for immigrating to Canada, when a paid representative is used. The website also clarifies that it is not mandatory for the applicant to use a paid representative. In fact, the released figures show that the proportion of applications with representation varies across the program, ranging from as high as 94% for the Immigrant Investor class to as low as 2-3% for certain refugees. [The focus of this article being Economic programs, we have not included figures and analysis for refugees, though the figures do show that their approval rate is also higher when represented.]

It would be safe to assume that, given that the information guides and application forms are freely available on CIC website, applicants who have a straight-forward case may not feel the need to use the services of a Paid representative. At the same time, the Immigration officers at Canada embassy are mandated to follow the provisions of the Immigration and Refugee Protection Act and its regulations. Since these are legal provisions, they are often-times difficult to follow and unravel for a layman. Information guides are for that purpose only - information and have a legal disclaimer stating that the Guide is not a legal document, and that the applicant should refer to the Act for legal information.

In the end, complex cases and those with past immigration history are more likely to be handled by the Paid representatives. In fact, this is one of the basic assumptions of the study as well. The differences are more significant with the assumption that paid representatives are employed in cases with the same or higher degree of difficulty.

The figures from CIC for the period 2009 to 2011 (September), show that the Applications represented by a paid representative had a higher rate of approval for many economic immigration categories. For instance, the latest figures for 2011 show that the rate of approval was as much as 62% higher under the Canadian Experience Class; 26% higher under the Federal Immigrant Investor class; and upto 16% higher for Federal Skilled Worker (FSW) applications. The rate of approval was 44% higher for Entrepreneur program in 2011, before the program was closed. According to a recent announcement, the Entrepreneur program is likely to be re-designed shortly.

So, what do the figures say?

There's a clear advantage to the Applicant when using an Authorised representative for their Canada visa application. Immigration is a life-altering decision and shouldn't be taken lightly. Once a decision is made, it is natural that the Application process and follow- through is also geared to maximise the chances of approval. The above figures and the fact that the services of representative can be found for as low as $300, should make the decision fairly straight-forward.
