"How to Choose a Personal Injury Lawyer: Why Experience Counts" talks about what Wilhelm calls the DNA of a case. He states that there are four important elements in every case. First is that there is liability meaning that someone else was at fault. "You want to be able to prove that somebody was at fault. The more wrong they were - usually the bigger verdict you can get because the jury will be mad," says Wilhelm.
The second element covered in the book is damages or injuries. Attorney Wilhelm notes that the third element of a case would be if there is someone you can collect against, such as an insurance company. And the fourth element of the case he writes about is the importance of having a nice client, and someone that the jury will like.
Towards the end of "How to Choose a Personal Injury Lawyer: Why Experience Counts" the author discusses the story behind the famous "Hot Coffee" case. He applauds the lawyer on that case for showing 27 previous violations of the law of serving the coffee too hot. So the jury realized there were 27 different instances where this happened before.
