Since the client had previously been charged with grand theft, he did not qualify for a diversion/first offender program under Florida law. After discussing the pros and cons of taking the plea with Ms. Gergely, the client chose to go to trial. During a long day of jury selection, Ms. Gergely was able to convince the prosecutor to offer a plea of disorderly conduct. As a result of this plea bargain, Ms. Gergely’s client was able to avoid probation and prevent a crime of dishonesty from marring his permanent record. Ms. Gergely’s client also received a withhold of adjudication which makes him eligible to have the disorderly conduct charge sealed down the road.
